No significant fiscal implication to the State is anticipated.
The bill would add a new section to Chapter 352 of the Local Government Code to allow the commissioners court of a county with a population of 3.3 million or more to prohibit or regulate the sale or use of fireworks in the unincorporated area of the county.
Based on the population limitation specified in the bill, the new section would apply only to Harris County. It is not known whether the Harris County commissioners court would decide to regulate or prohibit the sale of fireworks. However, if the Harris County commissioners court were to prohibit the sale of fireworks in the unincorporated area of the county, there would be a marginal reduction in state and local tax revenue.
The bill would take effect immediately upon enactment, assuming that it received the requisite two-thirds majority votes in both houses of the Legislature. Otherwise, it would take effect September 1, 2013.
Local Government Impact
Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government
