IN RE:
HB278 by Craddick (Relating to the liability of a municipality for certain space flight activities.), Committee Report 1st House, Substituted
No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to include the use of a municipality’s airport for certain space flight activities to the list of governmental functions for which a municipality would be liable for damages arising from its governmental functions. The common law doctrine of vicarious liability because of participation in a joint enterprise does not impose liability on a municipality for a claim for a municipal airport at which space flight activities occur.
According to the Office of Court Administration, no significant fiscal impact on the operation of the courts is anticipated.
Local Government Impact
According to the Texas Municipal League, no fiscal impact to municipalities is anticipated.
