LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

April 15, 2013

TO:
Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB577 by Guillen (Relating to the representation of certain applicants for writs of habeas corpus in cases involving the death penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would clarify that public defenders may be appointed to handle writs of habeas corpus applications except those involving the death penalty. Appointment in such cases is already discretionary and this change should not result in any additional attorney appointments.

The Office of Court Administration anticipates that any additional work resulting from the bill could be reasonably absorbed with current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
