No significant fiscal implication to the State is anticipated.
The bill would amend the Water Code to authorize a county commissioners court to review a petition for creation and other information relating to a proposed municipal utility district (MUD) to be located outside the corporate limits of a municipality. The Texas Commission on Environmental Quality (TCEQ) would be required to notify the commissioners court of the county in which the district is to be located promptly after a petition to create a MUD is filed.
According to TCEQ, under current statute TCEQ notifies the commissioners court of the creation of a MUD within a county if all or part of a MUD is located outside the extraterritorial jurisdiction of a municipality. TCEQ indicated no significant fiscal impact to the commission is anticipated.
