No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 49 of the Water Code to establish requirements relating to municipal water suppliers and would include a special utility district converted from a water supply corporation that would be considered a municipal water supplier.
 
The bill would add Section 49.513 that would apply only to a municipal water supplier that provides service to a municipality that has a population of 115,000 or more that is located in a county adjacent to an international border, and is the source of at least 70 percent of the total revenue received by a district from the diversion of raw water during the preceding year. The bill would require the Texas Commission on Environmental Quality (TCEQ) to amend a water right to authorize the delivery to and the diversion and use of water by a municipal water supplier as defined by the provisions of the bill. Based on the applicability criteria, the provisions would apply only to certain municipal water suppliers.
 
The Texas Water Development Board (TWDB) indicated no fiscal impact to TWDB is anticipated. The TCEQ indicated rulemaking would be required to implement the provisions of the bill; however, no significant fiscal impact on the agency is anticipated.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
