No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code to create the offense of unlawful transport of an undocumented person. Under the provisions of the bill, the punishment for this offense would be a state jail felony except that it would be punishable as a felony of the third degree if committed for pecuniary benefit or if there is substantial likelihood that the undocumented person would suffer bodily injury.

 

Expanding the list of behaviors for which a penalty is applied for any criminal offense is expected to increase demands on state and/or county correctional agency resources due to longer terms of community supervision, county jail confinement, state correctional institution confinement, and/or parole. However, in the case of this bill, the Legislative Budget Board assumes the number of offenders supervised or incarcerated under this statute would not significantly impact state correctional agencies’ workload and programs or the demand for their resources and services.
