No fiscal implication to the State is anticipated.

The bill would amend the Family Code to provide that a county clerk may not issue a marriage license if both applicants are absent unless an affidavit is provided that declares that the absent applicant is a member of the armed forces stationed in another country in support of combat or another military operation.
 
The bill would require a county clerk to maintain an affidavit of the absent applicant and the application for the marriage license in the same manner as a marriage license submitted by two applicants that appear in person.
 
The bill would amend the Health and Safety Code to require the county clerk to file a copy of any affidavit of an absent applicant with the bureau of vital statistics.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
