No fiscal implication to the State is anticipated.

The bill would create a Class A misdemeanor offense for intentionally or knowingly causing physical contact with a child that a reasonable person would regard as offensive and sexual in nature and likely to precede certain prohibited sexual conduct.

A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both.

The bill would take effect September 1, 2013.


Local Government Impact

Costs associated with enforcement, prosecution and confinement could likely be absorbed within existing resources. Gained revenue from fines imposed and collected is not anticipated to have a significant fiscal impact.
