LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

March 11, 2013

TO:
Honorable René Oliveira, Chair, House Committee On Business & Industry

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1087 by Giddings (Relating to the authority of a parent or legal guardian to establish a consumer file for a child or adult ward and act on the child's or adult ward's behalf with a consumer reporting agency.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would add a new section to the Business and Commerce Code establishing the authority of a parent or guardian to act on behalf of their child or adult ward in relation to a child or ward's consumer file.

The Office of the Attorney General and the Department of Family and Protective Services indicate that the bill would not have an impact to their agencies. The Office of Court Administration does not anticipate any significant fiscal impact to the court system resulting from the bill.

The fiscal impact that may be generated in association with implementing the provisions of the bill for the Office of the Consumer Credit Commissioner are not considered in this analysis because any fiscal impact for the agency would be realized outside of the Treasury due to the agency being Self-Directed and Semi-Independent.

The bill would take effect September 1, 2013.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
