The bill would amend the Labor Code relating to a database of employers convicted of certain offenses involving wage theft. The bill would require the Texas Workforce Commission (TWC) to make available on its website a publicly accessible list of all employers in Texas that have been convicted of an offense either under Section 61.019 of the Texas Labor Code or Section 31.04 of the Texas Penal Code if the offense involved the theft of a service that was rendered by an employee of the employer. The bill would require the database to include the name under which the entity operates and the name of each individual who is an owner of the entity. The bill would also require TWC to list the employer in the database until the third anniversary of the date of the conviction and establish the required database not later than December 1, 2013.
Based on information provided by the Texas Workforce Commission, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
