HB1242 by Geren (Relating to the authority of a judge to impose a period of confinement in a county jail for a violation of a condition of community supervision.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to authorize a judge to issue a warning that clearly communicates the consequences of violating a condition of community supervision, modify or revoke the community supervision, or require the defendant to serve time in a county jail if the judge has reason to believe a defendant has violated a condition of the community supervision. The bill would take effect September 1, 2013.

 

No significant impact on state correctional populations, programs, or workload is anticipated from any provisions of the bill that authorize or require a change in the sanctions applicable to adults convicted felony crimes.


Local Government Impact

There would be costs to a county if a judge ordered a defendant to serve time in a county jail, but the amount would vary depending on the number of defendants that violate community supervision, the amount of time served, and the daily cost of the county jail. According to the Texas Commission on Jail Standards, the average cost for an inmate in a county jail is $59.33 per day.
