LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

March 18, 2013

TO:
Honorable Joseph Pickett, Chair, House Committee On Homeland Security & Public Safety

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1304 by Sheets (Relating to the intentional display of a handgun.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 46.035, Penal Code, to make it an offense to display a handgun rather than to fail to conceal a handgun. The bill would also make it a defense to the prosecution to display the handgun when force, rather than deadly force, is justified.

Fiscal impact associated with enforcement, prosecution, confinement, and fines imposed and collected could be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
