No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to authorize a multidistrict litigation (MDL) pretrial court or the defendant to dismiss an action relating to an asbestos-related or silica-related injury case that was pending on September 1, 2005, that a claimant has not served a required report. The bill would require an MDL pretrial court to dismiss certain actions beginning on September 1, 2014, with all such actions being dismissed by August 31, 2015.
The bill would provide requirements related to subsequent actions filed by a claimant whose action was dismissed or who voluntarily dismissed an action, and for serving a petition and citation.
According to the Office of Court Administration, the provisions of the bill would not have a significant fiscal impact on the court system.
