HB1394 by King, Susan (Relating to the sunset review of certain powers and duties performed by the Department of State Health Services.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code as it relates to the sunset review of certain powers and duties performed by the Department of State Health Services (DSHS).   Under the provisions of the bill, during the next sunset review of DSHS, the Sunset Advisory Commision would be required to review the powers and duties of the Texas Health Care Information Council, within DSHS.  

The bill would require that the Sunset Advisory Commission determine whether the collection and retention of certain patient information is necessary to achieve the requirements of the Texas Health Care Information Council. 

Based on the analysis provided by the DSHS and the Sunset Advisory Commission, it is assumed that the provisions of the bill can be implemented within existing resources.

The bill would take effect immediately if a two-thirds majority vote in both houses of the Legislature is received, otherwise the bill would take effect on September 1, 2013.
