LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

April 2, 2013

TO:
Honorable Joseph Pickett, Chair, House Committee on Homeland Security & Public Safety

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1725 by Bohac (Relating to the procedures to modify employment termination reports for law enforcement officers.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code to revise the procedures whereby law enforcement officers may petition to contest the category of discharge cited in a termination report filed by their former employers with the Texas Commission on Law Enforcement Standards and Education (TCLEOSE).  Upon a finding by an administrative judge that the preponderance of evidence does not support the claim of misconduct included in the original termination report, the bill would direct TCLEOSE to replace the contested termination report with a modified termination report.  The bill would also repeal Section 1701.4525(e-1) of the Occupations Code to remove the authority of TCLEOSE to assess an administrative penalty against a law enforcement agency that did not change a termination report as ordered.

It is assumed the costs associated with implementing the provisions of the bill could be absorbed within current appropriations.  The bill would take effect September 1, 2013.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
