FROM:
Ursula Parks, Director, Legislative Budget Board
IN RE:
HB1845 by Gooden (Relating to capital murder of a prosecuting attorney or an assistant prosecuting attorney.), Committee Report 1st House, Substituted
No significant fiscal implication to the State is anticipated.
The bill would amend the Penal Code to expand the punishment of capital murder to cover a person who murders another person in retaliation for performing the duties of a prosecuting attorney or an assistant prosecuting attorney.
The bill increases the penalty for certain offenses of murder. This penalty adjustment is expected to increase demands on state correctional resources by increasing the length of confinement in state correctional facilities. However, in the case of the bill, it is assumed that the number of offenders incarcerated under this statute would not significantly impact state correctional agencies' workload and programs.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
