LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

March 29, 2013

TO:
Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1919 by Eiland (Relating to the defenses to prosecution of certain gambling offenses.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Penal Code to include an Internet website page that is accessible only through the use of a private password, to which the public does not have access, as a "private place" for the purposes of gambling.

The penalty for gambling in a private place is a Class C misdemeanor. A Class C misdemeanor is punishable by a fine of not more than $500.

Local Government Impact

Costs associated with enforcement and prosecution could likely be absorbed within existing resources. Revenue from fines imposed and collected is not anticipated to have a significant fiscal impact.
