HB2040 by Giddings (Relating to a complaint alleging the commission of an offense by a child on school property.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would forbid a peace officer from issuing a citation to a child alleged to have committed an offense on school property, but would allow the officer to take a child into custody.  The bill also prescribes requirements for a school to file a complaint in criminal court, including a sworn statement by a person with personal knowledge of the underlying facts of the offense.

No significant fiscal impact to the courts is anticipated.

The bill has no direct fiscal implications for the Foundation School Program (FSP) or the operations of the Texas Education Agency (TEA).

No significant administrative costs to school districts are anticipated.
