No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to authorize the commissioners court of a county with a population of 10,000 or less to contract with the governing body of a municipality to hold an arrested person in the municipal jail for not more than 72 hours. The county would be required to pay a daily per capita rate equal to the cost of maintaining an arrested person in the municipal jail or a rate on which the parties agree.

Under the bill's provisions, the Texas Commission on Jail Standards may not inspect or regulate a municipal jail that holds an arrested person pursuant to the bill's provisions.

The bill would take effect September 1, 2013.


Local Government Impact

There would be some additional workload to counties; however, any fiscal impact is not anticipated to be significant.
