No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code and the Occupations Code relating to the titling of nonrepairable, salvage, and abandoned motor vehicles and the regulation of those vehicles or parts from those vehicles. The bill would clarify the types of acceptable ownership documents or departmental receipt that a metal recycler may surrender as ownership evidence to the Department of Motor Vehicles (DMV). The bill would also require applicants for authorization to dispose of certain motor vehicles to give notice as provided by Transportation Code, Section 683.012. The bill would amend the Occupations Code to establish Class A misdemeanor and state jail felony offenses for violations related to salvage vehicle dealers and used automotive parts recyclers as outlined in the provisions of the bill.

 

Based on information provided by the DMV, it is assumed any duties associated with implementing the provisions of the bill could be accomplished utilizing existing resources.

 

No significant impact on state correctional populations, programs, or workload is anticipated from any provisions of the bill that authorize or require a change in the sanctions applicable to adults convicted of felony crimes.

Local Government Impact

The bill modifies misdemeanor offenses. Changes in costs associated with enforcement, prosecution, and confinement are not anticipated to have a significant fiscal impact. Changes in revenue from fines imposed and collected are not anticipated to have a significant fiscal impact.
