LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

March 26, 2013

TO:
Honorable Byron Cook, Chair, House Committee on State Affairs

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB2308 by Schaefer (Relating to facility reporting requirements for an abortion performed at an abortion facility.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would add Subchapter C to Chapter 171 of the Health and Safety Code, related to physician reporting requirements for an abortion performed at an abortion facility and authorizing the Department of State Health Services (DSHS) to assess administrative penalties aginst physicians. DSHS indicates that it does not have jurisdiction over the licensure of physicians and would need to refer any cases resulting from the bill's implementation to the Texas Medical Board (TMB). According to DSHS and TMB, any cost associated with implementing the bill would be absorbed within current resources. Potential revenue associated with the bill is not expected to be significant.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
