IN RE: | HB2396 by Bonnen, Greg (Relating to the penalty for certain family violence committed in the presence of a child.), As Introduced |
The bill would require a minimum term of confinement of 30 days for punishment for an assault offense if the offense is committed against a person that the offender is dating, a family member, or a person within the same household as defined by Family Code with regards to the offender, and the offender knowingly committed the offense in the physical presence of or within hearing range of a person who is younger than 15 years of age.
The bill would also require a judge granting community supervision to a defendant described above to require at least five days of continuous confinement in county jail as a condition of community supervision.
