No significant fiscal implication to the State is anticipated.
The bill would amend the Business and Commerce Code to require computer technicians report images of child pornography to local or state law enforcement. The bill would also classify any violation of the bill as a Class B misdemeanor punishable by a fine of not more than $2,000, confinement in jail for a term not to exceed 180 days, or both. It is assumed that the Office of the Attorney General would need to update agency training material and guidelines; however, it is anticipated that any costs associated with the bill could be absorbed within existing resources. It is also assumed that any revenue generated as a result of additional fines would not be significant.
Local Government Impact
Costs associated with enforcement, prosecution, and confinement could likely be absorbed within existing resources. Revenue from fines imposed and collected is not anticipated to have a significant fiscal impact.
