No significant fiscal implication to the State is anticipated.

The bill would amend the Family Code and Education Code as they relate to the educational needs of children in the conservatorship of the Department of Family and Protective Services (DFPS).

Changes that would be required by new subsections 107.002(i) and 107.004(d-2), Family Code, would apply only to a suit affecting the parent-child relationship filed on or after the effective date of the bill. A suit filed before the effective date of the bill is governed by the law in effect on the date the suit was filed, and the former law is continued in effect for that purpose.

The changes in law made by the bill to the Education Code would apply beginning with the 2013-2014 school year.

The bill would take effect September 1, 2013.

DFPS, the Office of Court Administration, and the Texas Education Agency do not anticipate any significant fiscal impact as a result of complying with the provisions of the bill.

No significant fiscal implication to units of local government is anticipated.
