No fiscal implication to the State is anticipated.
The bill would amend the Local Government Code to include a homestead that is protected by the Texas Constitution in which a municipality could file a lien on and assess costs incurred from a dangerous structure on the property, and would include property on which a swimming pool or fence is situated.
The bill would take effect January 1, 2014, only if the proposed constitutional amendment is approved by voters.
Local Government Impact
A municipality could incur costs to mitigate a dangerous structure on a protected homestead that would vary depending on the number of applicable protected homestead properties and the amount of costs incurred to vacate, secure, repair, remove or demolish a dangerous structure. In addition, a municipality that filed a lien to recover costs incurred may experience a positive fiscal impact which could offset all or some of the costs incurred.
The cities of Plano and Round Rock reported no fiscal impact is anticipated.
