The bill would add a new Chapter 122, Treatment and Recycling for Beneficial Use of Certain Oil and Gas Waste, to the Natural Resources Code. The new chapter would define the state's policy in regards to oil and gas waste. The Railroad Commission would be required to adopt rules to govern the treatment and beneficial use of oil and gas waste. The bill would also provide that changes in the responsibility for a tort involving possession of oil and gas waste does not change the liability of a person who treats oil and gas waste for personal injury, death, and property damage.
The bill would have an effective date of September 1, 2013.
The Railroad Commission does not expect any significant fiscal implications as a result of the bill's passage.
