LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

March 26, 2013

TO:
Honorable Tan Parker, Chair, House Committee on Corrections

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB2810 by Toth (Relating to the disposition of surplus data processing equipment by the Texas Department of Criminal Justice.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Government Code, Section 497.012(b) to allow, but no longer require, the Texas Department of Criminal Justice (TDCJ) to sell repaired and refurbished surplus or salvage data processing equipment, and to allow TDCJ to sell this equipment to nonprofit organizations. The bill would also repeal Government Code, Section 497.012(e) which requires the sales price of surplus data processing equipment be sufficient to defray the cost of repairing, refurbishing, or disassembling that equipment. TDCJ and the Texas Education Agency have determined the bill would not result in a significant fiscal impact to the State. The bill would take effect immediately upon receiving a two-thirds majority vote in each house, otherwise the bill would take effect September 1, 2013.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
