HB2930 by Miles (Relating to procedures for asserting taking claims against certain governmental entities.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would add a new chapter to the Civil Practice and Remedies Code specifying procedures for taking claims resulting from the enforcement of health and safety laws. The bill specifies that its provisions only apply to a taking claim in which the governmental entity is an incorporated municipality with a population of more than two million. The Office of Court Administration does not anticipate any significant fiscal impact to the court system resulting from the bill. The bill would take effect September 1, 2013. 


Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
