No fiscal implication to the State is anticipated.
The bill would amend the Local Government Code to allow the attorney general to bring an action to enforce Chapter 245. A political subdivision would be liable for actual damages and reasonable attorney's fees for a violation.
The Texas Education Agency (TEA) indicated the bill would have no direct fiscal implications for the Foundation School Program or the operations of the TEA.
The Office of the Attorney General anticipates any additional costs as a result of the passage of the bill could be reasonably absorbed by current resources.
Local Government Impact
There could be costs to a political subdivision for actual damages and attorney's fees for a violation; however, the amounts would vary depending on the number of violations and the amount of damages and attorney's fees.
