No fiscal implication to the State is anticipated.
The bill would amend Chapter 452 and Chapter 460 of the Transportation Code to limit the liability for passenger rail incidents under agreements between transportation authorities and railroads to $125 million for all claims for damages arising from a single incident. The limitation on liability would not apply to damages from willful misconduct or gross negligence, or to the Federal Employers' Liability Act.
