No fiscal implication to the State is anticipated.

The bill would amend the Penal Code to create Class A misdemeanors for offenses dealing with the violation of laws regulating gun show sales. A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both.

The bill would require a gun show promoter to provide written notice of a gun show to local law enforcement. A gun show promoter would also be required to have a criminal background check run on any person who purchases a firearm at a gun show. The bill would also require a gun show promoter to post notice of requirements relating to the background check.

It is assumed the costs of implementing the provisions of the bill could be absorbed within current appropriations.  The bill would take effect September 1, 2013. 


Local Government Impact

Costs associated with enforcement, prosecution, and confinement could likely be absorbed within existing resources. Revenue from fines imposed and collected is not anticipated to have a significant fiscal impact.
