FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

April 22, 2013

TO:
Honorable Byron Cook, Chair, House Committee on State Affairs

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB3147 by Anchia (Relating to the degree to which power generation facilities consume or adversely impact water in this state.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Utilities Code to require the independent organization certified under Section 39.151, Utilities Code, to consider the extent to which electric generating facilities consume or adversely impact water in this state. The bill would also require the independent organization, to the extent reasonably practical, to base decisions relating to the dispatch of generation upon the degree to which a facility consumes or adversely impacts water supplies. The bill would require the Public Utility Commission (PUC) to require the independent organization to submit its findings and any resulting actions to the commission.

Based on information provided by the PUC, duties and responsibilities associated with implementing the provisions of the bill could be accomplished utilizing existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
