No significant fiscal implication to the State is anticipated.
The bill would amend the Health and Safety code as it relates to the delivery of a controlled substance. Under the provisions of the bill, delivery of a controlled substance not listed in penalty group to a child would be punishable as a state jail felony. The bill would take effect immediately if a two-thirds majority vote in both houses of the Legislature is received. Otherwise, the bill would take effect on September 1, 2013.
It is assumed the provisions of the bill would apply only to an offense committed on or after the effective date of the act. For this analysis it is assumed implementing the provisions of the bill would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources of those agencies.
