No significant fiscal implication to the State is anticipated.

The bill would amend the Labor Code relating to reporting requirements for employers that do not obtain or otherwise provide workers' compensation insurance coverage.  The bill would require an employer who does not obtain or provide workers' compensation coverage to report on an annual basis to the Texas Department of Insurance (TDI) each work-related injury sustained by an employee during the preceding calendar year or portion of the year during which the employer did not offer coverage.  The bill would require the report to include the total cost of medical treatment, the portion of cost paid by the employer, the number of days the employee was absent from work, any wage replacement paid, and any other settlement amount paid by the employer.  The bill would require the Commissioner of Insurance to adopt rules for the administration of this section and prescribe forms to be used for the report.

Based on information provide by TDI, implementing the provisions of the bill would result in increased data collection responsibilities for the TDI-Division of Workers' Compensation; however, this analysis assumes that any costs associated with implementing the provisions of the bill could be accomplished utilizing existing staff and resources.
