No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code as it relates to the prosecution of the offense of indecency with a child. For indecency with a child offenses, the bill's provisions remove the requirement that the defendant be a member of the opposite sex than the victim to receive an affirmative defense. It is assumed that the number of offenders supervised or incarcerated under this statute would not significantly impact state correctional agencies' workload and programs.
