No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to authorize the Texas Department of Transportation (TxDOT) to enter into a comprehensive development agreement (CDA) for a nontolled state highway improvement project authorized by the legislature. The bill would authorize TxDOT to enter into not more than ten CDAs in a fiscal biennium in addition to the projects specified in Section 223.201(f), including a CDA for a rail facility or system as authorized by Transportation Code, Chapter 91. The bill would authorize a regional mobility authority (RMA) to enter into not more than two CDAs in addition to the projects specifically authorized in Section 223.2011.

 

Based on the information provided by TxDOT, it is assumed that any costs or duties associated with executing a CDA under the provisions of the bill would be accommodated within existing resources and through the allocation of the agency's existing highway planning and construction appropriations.
