The bill would amend the Code of Criminal Procedure to specify that a child has a privilege to refuse to testify against their parent or guardian in a criminal proceeding and amends the Civil Practice and Remedies Code to specify that a child has a privilege to refuse to testify against their parent or guardian in a civil proceeding. The bill would take effect September 1, 2013.
The Office of Court Administration does not anticipate any significant fiscal impact to the court system resulting from the bill. The Department of Family and Protective Services reports that the bill will not result in a fiscal impact to the agency.
