TO: | Honorable Abel Herrero, Chair, House Committee on Criminal Jurisprudence |
FROM: | Ursula Parks, Director, Legislative Budget Board |
IN RE: | HB3532 by Rose (Relating to resuming a criminal case after a defendant is determined to be competent to stand trial.), Committee Report 1st House, Substituted |
The bill would amend the Code of Criminal Procedure to impose meeting and notification requirements in certain cases and to require resumption of criminal court proceedings within the specified time period following certain competency hearings. The changes in law would apply only to a proceeding commencing on or after the bill's effective date. The bill would take effect immediately if receiving a two-thirds vote of each house, otherwise the bill would take effect September 1, 2013.
The Office of Court Administration does not anticipate any significant fiscal impact to the court system resulting from the bill.
