LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

May 13, 2013

TO:
Honorable Robert Nichols, Chair, Senate Committee on Transportation

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB3668 by Naishtat (Relating to an individual's responsibilities following an accident reasonably likely to result in injury to or death of a person; imposing criminal penalties.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code as it relates to an individual's responsibilities following an accident resulting in or reasonably likely to result in the injury to or death of a person. Under the provisions of the bill, the operator of a vehicle involved in an accident resulting in or reasonably likely to result in the injury to or death of a person would be required to immediately determine if a person is involved in the accident and if that person requires aid.  The bill would take effect on September 1, 2013 and apply only to an offense committed on or after the effective date of the Act.

Expanding the list of behaviors for which noncompliance is a specific criminal offense is expected to result in increased demands upon the correctional resources of counties and or of the state due to longer terms of probation, or longer terms of confinement in county jail, state jail, or prison. For this analysis it is assumed implementing the provisions of the bill would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources of those agencies.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
