No significant fiscal implication to the State is anticipated.

This bill would amend the Health and Safety Code and the Code of Criminal Procedure in order to implement new procedures relating to the seizure and disposition of firearms seized by a law enforcement agency from a person taken into custody under Section 573.001 of the Health and Safety Code, which deals with emergency detention of a person believed to be mentally ill. The bill provides procedures whereby a person may reclaim a firearm which has been seized and procedures for disposition of a firearm being held by a law enforcement agency or a firearm which has been left unclaimed.

The Office of Court Administration and the Department of Public Safety reported that any costs associated with the bill could be absorbed with existing resources.
