LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

April 22, 2013

TO:
Honorable Tracy O. King, Chair, House Committee on Agriculture & Livestock

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB3706 by Carter (Relating to certain requirements for certain sponsors and other participants in the summer food service program.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to expand the Texas Department of Agriculture's (TDA) authority to obtain criminal history record information maintained by the Department of Public Safety relating to a person who is a principal of a nongovernmental entity that is a participant in or applicant for participation in the Summer Food Service Program. Currently, the Government Code provides TDA the above authority for the Child Nutrition Program.
The Department of Public Safety reports the agency can implement the provisions of the bill within existing resources. TDA indicates minimal first year startup costs to update the agency's existing electronic data management system for provisions of the bill as well as minimal ongoing yearly program costs for obtaining background checks. This estimate assumes the agency can implement the provisions of the bill within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
