While the overall fiscal impact to state administrative costs would not be significant, the enactment of the bill would result in an indeterminate amount of revenue gain to the state.


The bill would amend the Transportation Code to authorize the governing body of a municipality to enact an ordinance to impose a civil penalty on the owner of a motor vehicle that displays a license plate; is parked on a highway that is under the municipality's jurisdiction; and that does not have a valid inspection certificate. The bill would establish certain defenses to prosecution for an offense. Violators of the registration and the vehicle inspection statutory provisions would still be liable for state-imposed penalties.
 
According to the Comptroller of Public Accounts, there is insufficient data to estimate the amount of revenue gain to the State from the additional administrative fee.

Local Government Impact

There would be an indeterminate revenue gain to municipalities that imposed the additional administrative fee that would vary depending on the number of violations and the amount of the fee assessed and collected.
