While the overall fiscal impact to state administrative costs would not be significant, the enactment of the bill would result in an indeterminate amount of revenue gain to the state.
The bill would amend the Transportation Code to allow a municipality to authorize parking enforcement officers to issue civil parking violations for an expired license plate, failure to display an inspection certificate, or an expired inspection certificate on a vehicle that is parked on the public right-of-way. A justice of the peace or municipal court judge may dismiss a charge if the defendant remedies the defect and has paid the fee; and may assess an administrative fee not to exceed $20. The bill would establish certain defenses to prosecution for an offense. Violators of the registration and the vehicle inspection statutory provisions would still be liable for state-imposed penalties.
According to the Comptroller of Public Accounts, there is insufficient data to estimate the amount of revenue gain to the State from the additional administrative fee.
