LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

April 26, 2013

TO:
Honorable Jimmie Don Aycock, Chair, House Committee on Public Education

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB3809 by Farney (Relating to counselors employed by school districts, including the use of consistent terminology in the Education Code to refer to school counselors and a license requirement for licensed professional counselors employed by school districts.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend statutory references to counselors in the Education Code to school counselors.

The bill would provide that a person could not be employed as a licensed professional counselor in a school district unless they held the appropriate credential from the appropriate state agency and held the appropriate certification.

The provisions of the bill would require an amendment of the State Board for Educator Certification rule.

Local Government Impact

A school counselor would be required to have a certificate and hold a professional license to be employed by a school district. Some school districts may experience costs if individuals serving in the capacity of a counselor no longer met eligibility requirements.
