FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

April 9, 2013

TO:
Honorable Harold V. Dutton, Jr., Chair, House Committee on Urban Affairs

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HJR123 by Bonnen, Dennis (Proposing a constitutional amendment authorizing the foreclosure of a lien on homestead property for costs incurred by a municipality relating to a dangerous structure on the property.), As Introduced

No fiscal implication to the State is anticipated, other than the cost of publication.

The cost to the state for publication of the resolution is $108,921.

The bill would amend Section 50, Article XVI of the Texas Constitution to provide that certain homesteads would not be protected from forced sale for the payment of the costs incurred by a municipality to vacate, secure, repair, remove or demolish a dangerous structure.

Local Government Impact

A municipality could incur costs to mitigate a dangerous structure on a homestead that would vary depending on the number of applicable homestead properties and the amount of costs incurred to vacate, secure, repair, remove or demolish a dangerous structure. In addition, a municipality may experience a positive fiscal impact from the forced sale of homestead property which could offset all or some of the costs incurred.

The cities of Plano and Round Rock reported no fiscal impact is anticipated.
