IN RE:
SB122 by Rodríguez (Relating to the removal from office of a member of the board of trustees of an independent school district.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to include a member of the board of trustees of an independent school district as one of the elected officials that a district judge may remove from office for incompetency, official misconduct, or intoxication on or off duty after a petition for removal is made and a trial by jury is held.

The bill has no direct fiscal implications for the Foundation School Program (FSP) or the operations of the Texas Education Agency (TEA).

Local Government Impact

A school district could incur legal costs associated with a trial by jury for a school board member receiving a removal citation. A school district could incur local administrative costs to appoint a new trustee or hold a special election to replace a trustee.
