The bill would amend the Family Code as it relates to an offense for failure to report abuse or neglect of a child.
The changes in law made by the provisions of the bill would apply only to an offense committed on or after the effective date of the bill. An offense committed before the effective date of the bill is governed by the law in effect on the date the offense was committed, and the former law is continued in effect for that purpose. For purpose of Section, 261.109, Family Code, an offense was committed before the effective date of the bill if any element of the offense occurred before that date.
The bill would take effect September 1, 2013.
According to the Department of Family and Protective Services and the Office of Court Administration, the bill would have no fiscal impact and no significant impact on state correctional populations, programs, or workload is anticipated from any provisions of the bill that authorize or require a change in the sanctions applicable to adults convicted of felony crimes.
