No significant fiscal implication to the State is anticipated.
The bill would amend sections of Chapter 42, Human Resources Code, that deal with inspections, background checks, and administrative penalties, and Chapter 43 that deal with background checks and the grounds for taking remedial action against an administrator's permit. The bill would require fingerprint-based background checks for all residential child-care providers. The bill would also require fingerprint-based background checks to be eligible for a child-care administrator's license. The bill would exempt from regulation by the Department of Family and Protective Services (DFPS) a facility operated by a nonprofit organization that provides emergency shelter and care for not more than 15 days to children of a certain age and meets other criteria. It is assumed the provisions of the bill could be implemented within existing resources.
