No significant fiscal implication to the State is anticipated.

Under the exception to public disclosure already provided under current law, the bill would amend Section 11, Article 49.25, Code of Criminal Procedure, to allow a governmental body to withhold photos and x-rays of a body during an autopsy without requesting a decision from the Attorney General’s Office.

The bill would take effect September 1, 2013.

Local Government Impact

The bill would likely reduce workload for counties that answer these types of public information requests. However, savings are not anticipated to be significant.
