LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

February 26, 2013

TO:
Honorable John Carona, Chair, Senate Committee On Business & Commerce

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB473 by Carona (Relating to the regulation of temporary common worker employers; providing a criminal penalty; authorizing fees.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Local Government Code relating to the regulation of temporary common worker employers and provide a criminal penalty.

This analysis assumes that duties and responsibilities associated with implementing the provisions of the bill could be accomplished utilizing existing resources based on information provided by the Department of Licensing and Regulation (TDLR) and the Department of Insurance.  This analysis also assumes that a revenue loss would be realized with the implementation of the bill based on information provided by TDLR; however, it is also assumed that the amount of revenue lost from the licensing and administrative penalty collections each year would be insignificant.

Local Government Impact

New revenue generated to municipalities would vary depending on existing policies in a given locality, how the bill would be implemented, and the number of licenses granted under the provisions of the bill; however, the fiscal impact is not anticipated to be significant.
